CONTRACT
IYANNA MONIQUE offers a free digital consultation service to the CLIENT via digital platforms (Zoom, Skype, WhatsApp, emails, and telephone calls) in order to outline broadly what is required of the company so that the services provided are tailored to the CLIENT's needs. A face to face consultation can also be arranged if needed. Any additional meetings, rehearsals or site visits requests will be charged. IYANNA MONIQUE will contact you either by phone or email prior to your event, to confirm the booking. Unless otherwise stated, commitment to last minute changes (e.g. timings, location, repertoire) may not be guaranteed.
IYANNA MONIQUE promises to fulfill its obligation to the CLIENT. In any case of emergencies beyond control that requires IYANNA MONIQUE to cancel, IYANNA MONIQUE will make every effort to secure a reputable replacement. If a suitable replacement is not found, IYANNA MONIQUE takes full and complete responsibility and liability. IYANNA MONIQUE will return all payments received from the CLIENT.
For setup IYANNA MONIQUE requires a table, chair and access to a power supply (within two metres). This is to be arranged by the CLIENT. Unless otherwise agreed, all other performance equipment (violin, music stand, scores and speakers) will be provided by IYANNA MONIQUE. During setup IYANNA MONIQUE will pick an appropriate location for positioning within the venue. Unless otherwise agreed, the entire performance will take place from this sole location. If there is a particular location within the room/venue that the CLIENT would like the performance to take place from, the CLIENT must make it known before the day of the event. As long as the preferred positioning is safe for both IYANNA MONIQUE and the musical equipment, it will be accommodated for. For outdoor events, it is the responsibility of the CLIENT to provide access to a power supply, as well as adequate protection for the musical equipment to protect against a change in weather during the performance (e.g. marquee and mat).
IYANNA MONIQUE requires 50% of the agreed fee at time of booking. This is a non-refundable retainer. Should the CLIENT cancel or otherwise breach this Agreement, the non-refundable retainer shall be liquidated for loss of bookings to IYANNA MONIQUE. The CLIENT shall also be responsible for payment of any materials/charges incurred up to the time of cancellation. Otherwise, the retainer shall be applied towards the final total, with the remainder of the charges payable in full, four weeks prior to the date of the event. IYANNA MONIQUE has a zero tolerance for late payments. Any late payment will incur interest of 5% a day of your outstanding balance and the risk of a no-show from the violinist on the day of the event. If the CLIENT does not make agreed payment by its agreed date, all terms of this contract are null and void.
The CLIENT agrees that the due performance of this agreement is subject to alterations or cancellation by IYANNA MONIQUE to any cause beyond its control including but not limited to sudden illness, death, equipment failure, injury, victim of crime, government lockdown, fire / explosion, storms and floods, natural disaster, disease outbreaks / epidemics / pandemics, severe weather conditions, earthquakes, wars, civil or military order, act of God, act of terrorism, shortage of material, and the failure of transportation. IYANNA MONIQUE, its associates or employees will not be held responsible and will not be liable for the delay or failure in agreement. Please note that all the non-refundable retainer shall be liquidated for loss of bookings to IYANNA MONIQUE if the CLIENT(s) cancels. Other payments received will be refunded. IYANNA MONIQUE will try its best to work in collaboration with the CLIENT(s) if they wish to postpone.
If on the day of the event the CLIENT requires the booking time to be amended, 30 minutes post the agreed booking end time can be accommodated for without charge. Requests for IYANNA MONIQUE to remain at the event for over 30 minutes post the agreed booking end time may be chargeable. This fee would be chargeable before the extended booking starts.
In the event that the CLIENT needs to change its prior booked date(s) with IYANNA MONIQUE, this can be accommodated for subject to availability. There may also be a set fee for loss of bookings to IYANNA MONIQUE for the original date. IYANNA MONIQUE will not be held responsible if the CLIENT(s) date is not available. Should The CLIENT cancel or otherwise breach their Agreement, the non-refundable retainer shall be liquidated for loss of bookings to IYANNA MONIQUE. If the booking is cancelled within four weeks of the original date, the full payment will be liquidated to cover rehearsal/material charges incurred up to the time of cancellation.
Should The CLIENT cancel or otherwise breach this Agreement, the non-refundable retainer shall be liquidated for loss of bookings to IYANNA MONIQUE due to your date being secured. If the event is cancelled within four weeks of the original date, the full payment will be liquidated to cover rehearsal/material charges incurred up to the time of cancellation.
IYANNA MONIQUE has a zero tolerance policy for any form of abuse whether verbal, physical or sexual. If any such incidents were to occur we would be forced to vacate the premises, which may also lead to legal action where liable.
It is mandatory that IYANNA MONIQUE is provided with a parking space at each location. Failure to do so will incur the CLIENT extra charges.
IYANNA MONIQUE is limited by the guidelines of the ceremony officials or reception site/venue management. The CLIENT agrees to accept the results that may occur from said guidelines. Negotiation with the officials for moderation of guidelines is solely the CLIENT’s responsibility.
The CLIENT hereby grants to IYANNA MONIQUE and successors, heirs, executors, administrators, assigns, attorneys, representatives and agents, the irrevocable and unrestricted right to use and publish media (pictures and videos) of the event, for editorial, trade, advertising, digital marketing or any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. The media may include attendees of the event, including the CLIENT. The CLIENT hereby releases IYANNA MONIQUE and all associates, representatives and assigns from any and all claims, actions, demands, suits, liabilities, damages, expenses, and obligations of any kind arising from or related in any manner to IYANNA MONIQUE use of said footages.
The CLIENT should first raise any complaints with IYANNA MONIQUE in writing within 21 days from the date of the event.
Out of respect for your privacy, the information we collect is for internal use only. By making payment, you agree that you have reviewed and understood the contents of this document and agree to the terms therein.
This contract and company is governed by the laws of the United Kingdom. This agreement is between the named parties on the invoice and IYANNA MONIQUE LTD regarding the subject matter hereof. It supersedes all prior agreements. The only way to add or change this agreement is to do so in writing, signed by all parties. IYANNA MONIQUE LTD is a company registered in England and Wales.
